ICE Enforcement at Airports Is Increasing: Green Card and Asylum Applicants Should Stay Informed

People taking at an airport.

Recent reports indicate that U.S. Immigration and Customs Enforcement (ICE) has increased enforcement activities at airports. In addition to individuals with final removal orders, some green card applicants, asylum applicants, and even travelers with valid Employment Authorization Documents (EADs) have reportedly been questioned or detained at airports.

‍

Who May Face Higher Risk?

The following individuals should pay close attention to their immigration status before traveling:

  • Individuals with a Final Order of Removal
  • Those who have overstayed a visa or lost lawful status
  • Pending asylum applicants
  • Individuals with a pending green card application (Form I-485)
  • Individuals with certain criminal records (such as DUI, domestic violence, or drug-related offenses)

Every case is different. Having a pending application does not automatically mean you will encounter enforcement, but your individual circumstances matter.

‍

ICE May Be Present at Domestic Airports

Many people believe immigration enforcement only occurs on international flights. However, ICE officers may also conduct enforcement activities at U.S. domestic airports, including ticket counters, TSA security checkpoints, and boarding gates.

Check Your Immigration Status Before You Travel

If you:

  • Have a pending green card or asylum application;
  • Previously overstayed your visa or fell out of status;
  • Have received notices from Immigration Court; or
  • Have a criminal record,

it is wise to speak with an experienced immigration attorney before traveling. Understanding your legal situation in advance may help you avoid unnecessary complications.
