Can ICE Arrest You at Immigration Court?

Yes. In some situations, ICE may arrest individuals at or near immigration court.

Recent reports from across the United States, including Los Angeles, have documented ICE arrests occurring after immigration hearings and during courthouse appearances. ICE has increasingly used courthouse enforcement as part of broader immigration enforcement efforts.

Who May Be at Higher Risk?

Individuals may face increased risk if they:

  • Have a prior removal order
  • Recently entered the United States
  • Have certain criminal convictions
  • Missed prior immigration court hearings
  • Have unresolved immigration status issues

ICE has also issued guidance identifying individuals with criminal histories, prior removal orders, or national security concerns as enforcement priorities.

Should You Skip Your Immigration Hearing?

No.

Failing to appear in immigration court can result in serious consequences, including an automatic removal order issued in your absence.

Even though courthouse arrests have become a concern, missing your hearing can often make your situation significantly worse.

What Should You Do Before Court?

  • Speak with an immigration attorney beforehand
  • Bring all immigration documents
  • Know your case status
  • Have an emergency contact available
  • Create a family preparedness plan if necessary

If ICE Approaches You

Remember:

✅ Stay calm
✅ Remain silent
✅ Do not sign documents you do not understand
✅ Ask to speak with an attorney

The Bottom Line

Many immigrants assume that attending court protects them from enforcement action. Unfortunately, that is not always the case.

If you have concerns about an upcoming immigration court appearance, it is important to understand your legal options before your hearing date.
