
In a landmark decision, the California Supreme Court has, for the first time, overturned a death sentence under the California Racial Justice Act (CRJA).
The case involved a defendant who was sentenced to death for a gang-related shooting in Los Angeles during the 1990s. The Court found that the prosecutor used racially charged language during the trial, violating the protections established by the California Racial Justice Act. As a result, the death sentence was reversed.
The California Racial Justice Act, enacted in 2020, was designed to prevent discrimination in criminal proceedings based on race, ethnicity, or national origin.

The California Supreme Court concluded that such language could encourage racial bias among jurors and undermine the defendant’s right to a fair trial. The Court therefore ruled that the comments violated the California Racial Justice Act and reversed the death sentence.
