Before You Talk to the FBI, Let Your Lawyer Talk First

The answer is yes—and in many situations, that's the better approach.

When the FBI contacts someone, the first reaction is often:

"I haven't done anything wrong. I'll just explain what happened."

However, federal investigations often begin months—or even years—before you receive that phone call.

For that reason, allowing your attorney to communicate with the FBI or federal prosecutors before you answer questions is often the safer and smarter option.

What Can a Lawyer Do for You?

1. Determine Your Status

One of the first things an attorney may try to determine is whether you are:

  • A Witness
  • A Subject of the investigation
  • A Target of the investigation

The legal risks associated with each status can be very different.

2. Learn What Information the FBI Already Has

In some situations, federal agents or prosecutors may be willing to share limited information with defense counsel, such as:

  • The general nature of the investigation
  • The conduct being examined
  • Whether a grand jury investigation is underway
  • Whether other witnesses or cooperators are involved

This information can be critical in developing a defense strategy.

3. Arrange and Attend Interviews

If an interview is appropriate, your attorney may:

  • Attend the meeting with you
  • Help define the scope of questioning
  • Prevent misunderstandings
  • Intervene when necessary to protect your rights

Having legal representation during an interview can help ensure that communications remain accurate and focused.

4. Discuss a Proffer Agreement

In certain federal investigations, your attorney may discuss options with prosecutors, including:

  • Proffer Agreements
  • "Queen for a Day" Sessions
  • Cooperation Agreements

Before providing any information, it is important to understand what legal protections may—or may not—apply.

Do You Have to Speak with the FBI?

Not necessarily.

Many FBI interviews are voluntary.

This means that, in many circumstances, you have the right to decline an immediate interview and seek legal advice before deciding how to proceed.

The Most Important Advice

If the FBI contacts you:

❌ Don't panic

❌ Don't rush to explain your side of the story

❌ Don't assume you know what evidence the government has

✅ Contact an attorney

✅ Allow your attorney to communicate with the FBI

✅ Understand your legal risks before making any statements

The Bottom Line

If the FBI wants to talk to you, the best first step is often not for you to speak to the FBI.

The best first step may be for your lawyer to speak to the FBI.

Early legal guidance can help protect your rights, avoid unnecessary mistakes, and ensure that important decisions are made with a full understanding of the situation.
