Bail Motions for ICE-Arrested Immigrants: Understanding Your Legal Options

When a loved one is arrested by Immigration and Customs Enforcement (ICE), it can be one of the most stressful experiences a family can face. Many people are unsure what happens next or whether the person can be released from detention. The good news is that in some cases, your attorney can file a motion for bond (bail) — giving the detained individual a chance to be released while their immigration case is pending.

What Is an ICE Bond?

An ICE bond is similar to bail in criminal court. It allows an immigrant detained by ICE to be released while awaiting immigration court hearings. The purpose is to ensure the person returns to court and complies with all immigration requirements.

The bond amount is determined by an Immigration Judge (IJ) or, in some cases, ICE officers. It can range from $1,500 to $25,000 or more, depending on factors such as:

  • The person’s ties to the community (family, employment, property ownership)
  • Criminal history or prior immigration violations
  • Risk of flight (likelihood of appearing in court)
  • Threat to public safety

Who Is Eligible for Bond?

Not everyone detained by ICE qualifies for bond. An immigrant may be ineligible if:

  • They have certain serious criminal convictions (known as “mandatory detention” cases)
  • They previously violated immigration court orders
  • They are deemed a flight risk or public safety concern

However, many individuals without prior serious offenses or with strong community ties can request a bond hearing to argue for release.

Filing a Motion for Bond (Bail Motion)

If ICE denies bond or sets it too high, your attorney can file a Motion for Bond Redetermination with the Immigration Court. This motion allows a judge to review the decision and possibly lower or grant bond.

At Perliss Law Firm, we help clients:

  1. Prepare evidence – including letters from family, employers, or community leaders showing good moral character.
  2. Present arguments – demonstrating the person is not a flight risk or danger to the community.
  3. Negotiate bond amounts – and ensure the process complies with ICE and court procedures.

What Happens After Release?

Once released, the immigrant must attend all future court hearings and follow any conditions set by the court. Failure to appear could result in bond forfeiture and additional immigration consequences.

Release through bond allows families to reunite, and gives the detained individual the opportunity to work on their immigration defense from outside detention — a critical advantage when preparing for hearings and gathering evidence.
